John and his second wife Elizabeth came to Australia in 1849 as assisted immigrants, bringing with them six of his and Rebecca’s children. John had married Elizabeth Sherriff the daughter of Joseph Sherriff occupation Confectioner and Ann Bachelor. They were married on the 1st of October 1848 at the Parish Church in Chipping Wycombe, Buckinghamshire, England. The witnesses were Thomas Clark and Ellen Sherriff. From her death certificate no. 564, Elizabeth Weller had died on the 16th of March 1869, at Union St, Little Brighton, Victoria. Cause of death was Dropsy. A doctor had not attended Elizabeth at all in the 12 months leading up to her death. The Coroner ruled there was no need for an inquest. The informant on her death certificate was her husband John Weller. She was buried at Brighton General Cemetery on 18th March 1869. Elizabeth was noted as being born in Buckinghamshire, England, she had been in Victoria 20 years. The place where her marriage to John Weller at the age of 38 years was noted as High Wycombe, Buckinghamshire, England. It appears that Elizabeth had no children of her own.
John Weller married Martha Turner Fisher on 11th December 1869. On the marriage certificate it states John is the son of Thomas Weller a butcher by profession and Charlotte Morris. He is listed as being born at High Wycombe, Buckinghamshire, England. His age given on certificate ref: 4444 was 66years. His place of residence was Little Brighton and his profession was a carpenter.
John Weller died in hospital, in the Gipps ward, City of Melbourne, County of Bourke on 27th August 1883. John was 79 years of age at the time of his death, cause of death senile decay, length of his illness was not known. He was buried at Kangaroo Ground Cemetery on the 31st August 1883. John had been born in Buckinghamshire, England; he had lived 33 years in Victoria. The informant on the death certificate was a member of staff at the Hospital where John died; this explains the errors on his certificate. Profession was listed as being a labourer. John is noted as marrying Mary (should be Rebecca) White at the age of 25 in Buckinghamshire, England. There was no mention of Elizabeth on his death certificate Vic B.D.M reg no. 8951. His children noted on his certificate were: Rebecca, Mary Ann, Richard, Elizabeth, 1 dead (Edward) and one unknown (John). Richard Baraby Finch Weller applied for probate for John’s estate as no will was found. On his request for Grant of probate no 28/702, Richard stated he was representing his siblings: Rebecca Scarce, Mary Ann Waghorne (Waghorn), Elizabeth Sadler (Sadlier), John Weller and himself, there no mention of Edward’s widow Mary. Richard stated that there had been a woman who had lived with his father around 1875 who was called Mrs Weller. Richard Claimed she was not John`s wife and that he had not been able to trace her. She had been about 70 years old at the time of her acquaintance with his father. This was dated 8th October 1884. John`s estate was Twenty-five pounds in assets; he had no liabilities record against his estate. On his application for Probate Richard stated that John Weller had been a carpenter at Kangaroo Ground, Colony of Victoria.
